Senator Leila de Lima plans to file a demurrer in her final drug case

Former Senator Leila de Lima’s legal team intends to file a motion for leave of court to submit a demurrer to evidence regarding the last drug case against her. If granted, this motion would allow De Lima to seek the dismissal of the case without presenting further evidence. Boni Tacardon, De Lima’s lawyer, stated that they are prepared to file the demurrer to evidence along with the motion. If successful, this demurrer could lead to the dismissal of the criminal case, effectively resulting in an acquittal for De Lima. The prosecution has been given 15 days to respond to the motion for leave. The Muntinlupa Regional Trial Court Branch 206 recently issued a resolution on the formal offer of evidence from the defense. Despite facing her third and final drug case related to alleged involvement in the drug trade at New Bilibid Prison, De Lima remains optimistic, having been freed on bail. Previous drug charges against her were dismissed in 2021 and 2023.
